As a general rule, solar energy systems are to be considered a building technical installation that is subject to an application under the Planning and Building Act (PBL) § 20-1 first paragraph letter f, cf. PBL § 20-2. However, it follows from the Building Regulations (SAK10) § 4-1 first paragraph letter e no. 4 that the installation of simple installations in existing buildings within a utility unit or fire cell is exempt from the requirement for building application processing. This applies if the measure is not in conflict with the provisions of the Act with associated regulations, the municipal plan's area section and zoning plan, permits or other regulations.

Is the solar energy system subject to application?
Installing solar energy systems in existing buildings within a utility unit or fire cell, for example on the roof or wall of a detached house, will in many cases be a simple installation that is exempt from the requirement for an application. Nevertheless, it is the case that solar energy systems come in many shapes and sizes, which must be taken into account when assessing whether the exemption from the application requirement can be used.
It therefore follows from the guidance to SAK10 § 4-1 first paragraph letter e no. 4 that "when assessing whether an installation is simple, emphasis shall be placed on the scope of the installation, degree of difficulty, professional qualifications required and consequences of any errors. The assessment must be based on the size of the system and not the size of the building." The question of whether a solar energy system entails a facade change that requires an application may also be relevant to consider.
